Home Growing Rules

Adults 21 and older can cultivate cannabis at home for personal use:

  • Up to 3 mature and 3 immature plants per person,

  • With a household maximum of 6 mature + 6 immature plants.

Plants must be:

  • Out of public view (not visible from the street),

  • Grown securely to prevent access by minors or pets,

  • Used for personal consumption only — selling home-grown cannabis remains illegal.

Home grow rights officially began for medical patients in 2023 and for all adults in 2024 after OCM finalized its cultivation rules.

Delivery, Gifting, and Sharing

Adults may gift up to 3 ounces of cannabis to another adult (21+), but sales or exchanges involving money, goods, or services remain illegal without a license. Licensed delivery services can bring products directly to your home if you verify your age with ID at delivery.

Buying Cannabis Legally

Only licensed dispensaries can sell cannabis products in New York. Each licensed location must display a valid OCM (Office of Cannabis Management) certificate.
Avoid “sticker shops” or unlicensed retailers—purchases made there are not protected under state law. You can verify any dispensary’s license using the official OCM Dispensary Verification Tool.

What’s Legal in New York

Adults aged 21 and over can legally possess, purchase, and consume cannabis in New York State. The law allows possession of up to 3 ounces of cannabis flower or 24 grams of concentrate for personal use. Consumption is permitted anywhere smoking tobacco is allowed—except in cars, schools, or workplaces that prohibit it.

U.S. Cannabis Legalization: Recreational & Medical

As of mid-2025: Recreational cannabis is legal in 24 states + Washington, D.C. Medical cannabis is legal in 38 states + D.C. Program scope varies by state—some offer full medical access, while others allow limited or low-THC products only. Qualifying conditions, possession limits, home-grow rules, and retail availability differ by jurisdiction, and medical legalization does not always mean active dispensary access statewide.
